0:31:05.680,0:31:07.640 were making use of[br]what you would have to call 0:31:07.640,0:31:12.400 loopholes in the law[br]of one kind or another. 0:31:12.400,0:31:15.600 Things which had been put in the law[br]not with homeschooling in mind, 0:31:15.600,0:31:20.080 but with something quite different. 0:31:20.080,0:31:23.200 In many places,[br]in many states around the country, 0:31:23.200,0:31:26.920 the compulsory school attendance laws[br]had some kind of a clause in them 0:31:26.920,0:31:33.160 about kids have to go to school or get some[br]equivalent kind of instruction or education. 0:31:33.160,0:31:38.760 Now, this clause was not put into the law[br]to make things easy for homeschoolers, 0:31:38.760,0:31:40.240 but to take care[br]of children who, 0:31:40.240,0:31:43.880 for mostly medical reasons,[br]were not able to go to school. 0:31:43.880,0:31:48.320 And they were probably thinking of[br]retarded or emotionally disturbed children 0:31:48.320,0:31:50.200 who couldn't go[br]to school because 0:31:50.200,0:31:52.320 the schools didn't want them,[br]or couldn't handle them. 0:31:52.320,0:31:57.560 So they wanted to make[br]some kind of legal alternative. 0:31:57.560,0:31:59.760 The farthest thing they could[br]have had from their minds, 0:31:59.760,0:32:02.680 the legislatures, when[br]they put these clauses in, 0:32:02.680,0:32:06.240 was that people who had[br]the choice of sending their kids to school, 0:32:06.240,0:32:11.640 people whose kids were,[br]as they say, normal, 0:32:11.640,0:32:13.480 would decide that they didn't[br]want to send them to school 0:32:13.480,0:32:15.320 so they could[br]teach them themselves. 0:32:15.320,0:32:16.960 Nevertheless, there was[br]that loophole. 0:32:16.960,0:32:20.600 And for a while, in lots of places,[br]people were slipping through. 0:32:20.600,0:32:23.680 The other great loophole[br]was the private school loophole 0:32:23.680,0:32:27.840 where many states in the country in which[br]private schools were not regulated by law 0:32:28.440,0:32:32.600 or not regulated by[br]the compulsory school attendance law – 0:32:32.600,0:32:36.800 Now, that was not done[br]to make homeschooling possible. 0:32:36.800,0:32:41.480 It was done for[br]quite other sorts of reasons. 0:32:41.480,0:32:45.160 When legislators decided that[br]private schools would not be regulated, 0:32:45.160,0:32:50.720 it was to a large degree because private[br]schools had their own police mechanisms, 0:32:50.720,0:32:55.720 they - ago,[br]we began to see – I say roughly – 0:35:16.517,0:35:21.480 it differs rom state to state –[br]but we began to see the beginnings of attempts – 0:35:21.480,0:35:23.480 in some cases in the form of laws, 0:35:23.480,0:35:27.320 and in some cases in the form [br]of administrative regulations – 0:35:27.320,0:35:31.877 attempts to make homeschooling illegal[br]or virtually impossible – 0:35:31.877,0:35:38.680 in Maryland, and Georgia, and[br]in other states – for a while in California, 0:35:38.680,0:35:42.120 which had been one of[br]our chief homeschooling states – 0:35:42.120,0:35:48.880 the authorities began to try to think of[br]ways of making this very difficult. 0:35:48.880,0:35:52.840 And a couple of years ago,[br]we at Growing Without Schooling 0:35:52.840,0:35:59.340 certainly felt that the homeschooling movement[br]was in a kind of fight for its life. 0:35:59.340,0:36:01.440 Well, I don't mean to say[br]that the fight isn't over, 0:36:01.440,0:36:07.520 but in fact, none of those attempts[br]to rule out homeschooling, stamp it out, 0:36:07.520,0:36:10.600 make it impossible,[br]none of them succeeded. 0:36:10.600,0:36:18.040 In no place has a legislature written a kind of[br]anti-homeschooling law in that sense. 0:36:18.040,0:36:26.600 We've been under lots of pressure,[br]lots of pressure to do so.
