Kim Bernhardt Information Gathering

  • 0:07 - 0:12
    Information gathering
  • 0:12 - 0:15
Do you have a good understanding of the issues and how they'll play out
  • 0:15 - 0:18
Particularly in the area of human rights legal principles.
  • 0:18 - 0:21
There's some unique factors such as similar fact evidence
  • 0:21 - 0:26
there's too many of them. I won't go down that road
  • 0:26 - 0:29
There's a lot that would be helpful.
  • 0:29 - 0:39
If you need to figure out why a person is seeing a particular comment as racism
  • 0:39 - 0:44
or sexism or ableism, or homophobia, educate yourself.
  • 0:44 - 0:49
Do you need updated medicals? Do you need expert evidence?
  • 0:49 - 0:53
Both of these need to be obtained fairly early in the process.
  • 0:53 - 0:59
Finally, one of the biggest areas for the initial stages
  • 0:59 - 1:01
Is building the relationship with the person with the complaint.
  • 1:01 - 1:06
It's one of the most important but it's one of the least worked upon factors
  • 1:06 - 1:09
We're always running so much we just assume the person wants our help.
  • 1:09 - 1:12
That they see it that way, but they don't.
  • 1:12 - 1:14
They don't know you, they don't know to trust you
  • 1:14 - 1:17
with one of the most traumatic events in their life.
  • 1:17 - 1:22
Without trust and cooperation you will spend your time defending yourself, your actions
  • 1:22 - 1:27
and your movtivations, rather than working together to reach a successful conclusion.
  • 1:27 - 1:33
Make sure you listen and understand the member's position.
  • 1:33 - 1:38
Take the time to develop a trusting relationship. It will really help
  • 1:38 - 1:41
When you need them to listen to you, when you're advising
  • 1:41 - 1:44
on whether to take a settlement or not, for example.
  • 1:44 - 1:50
Show caring by ensuring that the member has the necessary supports.
  • 1:50 - 1:52
What is their current financial situation?
  • 1:52 - 1:56
Are they sitting out there without any sort of income that they could be getting
  • 1:56 - 2:04
You shouldn't become their counsellor. You're their union contact person.
  • 2:04 - 2:10
But make sure they have the emotional support that they need.
  • 2:10 - 2:15
It will save you and it will help them be stronger to get through it.
  • 2:15 - 2:23
The other role you have is managing expectations.
  • 2:23 - 2:30
Make sure you let the member know what you're doing and what to expect.
